Welcome to Bergez. The terms "we", "us" and "our" refer to Bergez. Bergez operates this store and website, including all related information, content, features, tools, products and services in order to provide you, the customer, with a curated shopping experience (the "Services"). Bergez is powered by Shopify, which enables us to provide the Services to you.

The below terms and conditions, together with any policies referenced herein (these "Terms of Service" or "Terms") describe your rights and responsibilities when you use the Services. These Terms are governed by Belgian law and comply with the Belgian Code of Economic Law (Book XII) and EU consumer protection directives.

Please read these Terms of Service carefully. By visiting, interacting with or using our Services, you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree to these Terms of Service or Privacy Policy, you should not use or access our Services.

Section 1 — Access and Account

By agreeing to these Terms of Service, you represent that you are at least 18 years of age (the age of majority in Belgium), or that you have the consent of a parent or guardian. You are solely responsible for maintaining the security of your account credentials and for all activity under your account. You may not transfer, sell, assign, or license your account to any other person.

Section 2 — Our Products

We have made every effort to provide an accurate representation of our products in our online store. However, please note that colours or product appearance may differ slightly from how they appear on your screen due to your device settings and calibration. For natural wool products, minor variations in texture and colour are inherent to the material and are not considered defects.

All product descriptions are subject to change at any time at our sole discretion. We reserve the right to discontinue any product at any time.

Section 3 — Orders and Contract Formation

When you place an order on our website, you are making an offer to purchase. Your order constitutes a binding offer only upon our written confirmation (order confirmation email). Bergez reserves the right to accept or decline your order for any reason at its discretion.

In accordance with Belgian and EU consumer law, the sales contract between you and Bergez is concluded at the moment we send you an order confirmation email. The button you click to finalise your order will clearly indicate an obligation to pay ("Order with obligation to pay" / "Commande avec obligation de paiement" / "Bestelling met betalingsverplichting").

Please review your order carefully before submitting. In the event that we do not accept, modify, or cancel an order, we will notify you by email at the address provided at the time of order.

Section 4 — Prices, Taxes and Billing

All prices displayed on our website are inclusive of Belgian VAT (21%) unless otherwise stated. Shipping costs are displayed separately and added at checkout before you confirm your order.

Prices are subject to change without notice. The price charged will be the price in effect at the time the order is placed, as confirmed in your order confirmation email.

For deliveries within the EU, the applicable VAT rate is that of the destination country where required by law (EU OSS regime). For deliveries outside the EU, prices are exclusive of any applicable customs duties or import taxes, which are the responsibility of the recipient.

You agree to provide accurate, current and complete payment information. You represent and warrant that you are duly authorised to use the payment method provided.

Section 5 — Shipping and Delivery

Delivery times are estimates only and are not guaranteed. Bergez is not liable for delays caused by shipping carriers, customs processing, or events outside our control. Risk of loss and title for products pass to you upon delivery to the carrier.

We ship from Belgium using trusted carriers including bpost, DHL, and GLS. Shipping zones, estimated delivery times, and costs are detailed on our Shipping & Delivery page.

For deliveries to the United Kingdom: orders below £135 are subject to UK VAT collected at checkout. Orders above £135 may be subject to customs duties payable by the recipient upon delivery.

Section 6 — Right of Withdrawal (EU Consumer Right)

In accordance with the EU Consumer Rights Directive (2011/83/EU) as implemented in Belgian law, you have the right to withdraw from this contract within 30 days without giving any reason. The withdrawal period expires 30 days from the day on which you, or a third party indicated by you, acquires physical possession of the goods.

To exercise the right of withdrawal, you must inform us of your decision by a clear statement (e.g. by email to office@bergez.com) before the withdrawal period expires. You may use the standard withdrawal form below, but it is not obligatory.

If you withdraw, we will reimburse all payments received from you, including delivery costs (with the exception of supplementary costs arising from your choice of a delivery type other than the least expensive standard delivery we offer), without undue delay and no later than 14 days from the day we receive back the returned goods or evidence of shipment. We will use the same payment method for the reimbursement unless expressly agreed otherwise.

You shall return the goods without undue delay and no later than 14 days from the day you communicate your withdrawal. Return shipping costs are at your expense for orders outside Belgium. For orders within Belgium, a prepaid return label will be provided.

The right of withdrawal does not apply to:

•       Goods made to your specifications or clearly personalised.

•       Sealed goods which are not suitable for return due to health protection or hygiene reasons and which have been unsealed after delivery.

Section 7 — Returns, Exchanges and Refunds

Products must be returned in their original condition — unused, unwashed, with all original tags and packaging intact. Refunds are processed within 5–10 business days of receiving the returned goods.

Section 8 — Legal Guarantee of Conformity

In accordance with EU Directive 2019/771 on the sale of goods, as implemented in Belgian law, all products sold by Bergez are covered by a legal guarantee of conformity of a minimum of 2 years from the date of delivery. During this period, if a product proves to be defective or non-conforming, you are entitled to repair, replacement, a price reduction, or a full refund, depending on the circumstances.

This legal guarantee is without prejudice to any additional commercial guarantee we may offer. To make a claim under the legal guarantee, please contact us at office@bergez.com with your order details and a description of the defect.

Section 9 — Intellectual Property

Our Services, including all trademarks, brands, text, images, graphics, product photography, video, and audio content, are owned by Bergez or its licensors and are protected by applicable intellectual property laws. You may not reproduce, distribute, modify, or transmit any content from our Services without our prior written consent.

Section 10 — Optional Tools and Third-Party Links

We may provide access to third-party tools and links to third-party websites as part of our Services. We are not responsible for the content, accuracy, or practices of third-party websites. Your use of optional third-party tools is at your own risk.

Section 11 — Relationship with Shopify

Bergez is powered by Shopify, which enables us to provide the Services to you. However, any sales and purchases you make are made directly with Bergez. Shopify is not responsible for any aspect of any sales between you and Bergez, including any injury, damage, or loss resulting from purchased products and services.

Section 12 — Privacy Policy and GDPR

All personal information we collect through the Services is subject to our Privacy Policy, which is available on our website and complies with the GDPR (EU 2016/679) and the Belgian Law of 30 July 2018. By using the Services, you acknowledge that you have read our Privacy Policy.

Section 13 — Feedback and Reviews

If you submit feedback, reviews, or other content to us, you grant Bergez a perpetual, worldwide, royalty-free licence to use, reproduce, modify, publish, and distribute such content for the purposes of operating and improving our Services. You represent that you own or have all necessary rights to the content submitted.

Section 14 — Errors, Inaccuracies and Omissions

Occasionally there may be typographical errors, inaccuracies or omissions on our website relating to product descriptions, pricing, promotions, shipping charges, or availability. We reserve the right to correct any errors and cancel orders where information was materially inaccurate, with full refund to you.

Section 15 — Prohibited Uses

You may access and use the Services for lawful purposes only. You may not use the Services: for any unlawful or malicious purpose; to infringe upon intellectual property rights; to transmit false or misleading information; to send unsolicited commercial communications; or to engage in any conduct that restricts or inhibits use of the Services by others.

Section 16 — Disclaimer of Warranties

The Services are provided on an 'as is' and 'as available' basis. To the extent permitted by Belgian and EU law, Bergez makes no warranties, express or implied, regarding the Services. This disclaimer does not affect your statutory rights as a consumer under Belgian and EU law, including the legal guarantee of conformity described in Section 8.

Section 17 — Limitation of Liability

To the fullest extent permitted by Belgian law, Bergez shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Services. Nothing in these Terms limits or excludes our liability for death or personal injury caused by our negligence, fraud, or any liability that cannot be excluded under Belgian or EU consumer law.

Section 18 — Termination

We may terminate your access to the Services at any time without notice if you breach these Terms. Sections relating to Intellectual Property, Governing Law, Disclaimer of Warranties, and Limitation of Liability shall survive termination.

Section 19 — Online Dispute Resolution (ODR)

In accordance with EU Regulation 524/2013, if you are a consumer resident in the EU and have a complaint about a product or service purchased online, you may use the European Online Dispute Resolution platform at: ec.europa.eu/consumers/odr

We are not obliged to participate in alternative dispute resolution but will endeavour to resolve any complaints directly. Please contact us first at office@bergez.com.

Section 20 — Governing Law and Jurisdiction

These Terms of Service shall be governed by and construed in accordance with Belgian law. For consumer disputes, you may bring proceedings in the courts of your place of residence within the EU, or in the courts of Belgium. Nothing in these Terms affects your rights as a consumer under mandatory provisions of the law of your country of residence.

Section 21 — Severability and Entire Agreement

If any provision of these Terms is found to be unlawful or unenforceable, that provision shall be deemed severed and the remaining provisions shall continue in full force. These Terms, together with our Privacy Policy, Cookie Policy, and Returns Policy, constitute the entire agreement between you and Bergez.

Section 22 — Changes to Terms of Service

We reserve the right to update these Terms at any time. Material changes will be communicated to you by email or via a prominent notice on our website, with a minimum of 15 days notice before the changes take effect. Your continued use of the Services after the effective date constitutes acceptance of the updated Terms.
